1. In General

Before placing an order, if you have any queries relating to these terms and conditions, please email our team at customerservice@staydench.com. By using this website and/or placing an order you agree to be bound by the terms and conditions as set out below.

2. Privacy Policy

Please refer to our Privacy Policy regarding the personal information provided by you, and how we will make use of this data.

3. Your Position

When placing an order through our site, you agree that you are legally capable of entering into a binding contract; you are at least 18 years old; you are resident in one of the Serviced Countries; and you are accessing our site from that country.

4. The Contract

After placing an order, you will receive an email from us to acknowledge thatwe have received your order. This does not necessarily mean that your order has been accepted. Your order constitutes an offer to us to buy a product. All orders are subject to acceptance by us, and we will confirm such acceptance to you when the goods have been delivered. The contract between us (Contract) will only be formed when we deliver the products to you. We reserve the right to make any changes in the specification of the products which are required to conform with any applicable statutory or EC requirements or, which do not materially affect their quality or performance.

5. Intellectual Property

The intellectual property rights in all software and content made available to you on or via this website remains the property of Stay Dench or its licensors and are protected by copyright laws and treaties around the world. All such rights are reserved by Stay Dench and its licensors. You have the right to store, print and display the content supplied solely for your own personal use. However, you are not permitted to publish, manipulate, distribute or otherwise reproduce, in any format, any of the content or copies of the content supplied to you or which appears on this website nor may you use any such content in connection with any business.

Some files are stored on the DigitalFlare website design agency server, if for any reason there are issues with this website server the site may not display banner images correctly. These files are hosted this way because the template will not allow us to custom-edit the website template files, so we need to store these files elsewhere.

6. Our Product

6.1 Description of goods

We have done our best to display as accurately as possible the colours of the products shown on the web site. However, because the colours displayed will depend on your computer's set up, we cannot guarantee that your monitor's display of any colour will be accurate.

6.2 Prices

Prices are subject to change without notice. Prices are inclusive of VAT (where applicable).

6.3 Sizing

All sizes and measurements are approximate (but unless stated refer to UK sizes). We do make every effort to ensure they are as accurate as possible.

7. Your order

7.1 Cancellation

Your right to cancel is detailed in the Delivery/Returns section. You will not have any right to cancel a contract for the supply of swimwear and underwear.

7.2 Availability of goods.

Goods are subject to availability. If an item you have ordered becomes out of stock before we accept the order we shall notify you as soon as possible; you will not be charged for the out of stock items.

7.3 Delivery

7.4 Import Duty

If you order from our site for delivery outside the UK, they may be subject to import duties and taxes which are levied when the delivery reaches the specified destination. If such import duties and taxes are levied it is your responsibility to pay for them. We have no control over these charges and therefore cannot predict their amount. If you’re in doubt please contact your local customs office for further information before placing your order. In addition please note that you must comply with all applicable laws and regulations of the country for which the products are destined. We will not be liable for any breach by you of any such laws.

Please contact us if you have any complaints of comments. We will do our best to resolve any disputes when they first arise.

11 Events beyond our control ('Event')

We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a Contract that is caused by events outside our reasonable control, including any act, eventnon-happening, omission or accident beyond our reasonable control and includes in particular (without limitation) the following: Strikes, lock-outs or other industrial action; Civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat orpreparation for war; Fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster; Impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private

transport; Impossibility of the use of public or private

telecommunications networks; The acts, decrees, legislation, regulations

or restrictions of any government. Our performance under any Contract

is deemed to be suspended for the period that the 'Event' continues, and

we will have an extension of time for performance for the duration of that

period. We will use our reasonable endeavours to bring the 'Event' to a

close or to find a solution by which our obligations under the Contract

may be performed.
